83.6 million. Fraud, misrepresentation, and breach of contract. S.D. Tex. The plaintiff won a competitive bid to contract for the cleanup of seven lagoons at a Superfund site. After work began, plaintiff realized that its bid was inad-equate because the materials in the lagoons were worse than expected. The plaintiff sued the primary dumper, and the trust fund set up to clean the site, for fraud, negligent misrep- resentation, and breach of contract. The award included $28.5 million in punitive damages and $2.3 million in attorneys' fees. The judge threw out the punitive damages and fraud claim, reducing the award to $43.7 million.
